These Terms and Conditions ("Terms") govern the use of services provided by Supportly Remote ("Company," "we," "us," or "our"). By purchasing, accessing, or using our remote IT support services, you ("Client," "you," or "your") agree to be bound by these Terms.
1. Scope of Services
Supportly Remote provides remote IT support services, which may include troubleshooting, software installation, system configuration, maintenance, and general technical assistance. Services are provided remotely unless otherwise agreed in writing.
We do not guarantee that all issues can be resolved, especially where problems are caused by third-party software, hardware failures, internet service providers, user actions, malware, or pre-existing system conditions.
2. Client Responsibilities
You agree to:
Maintain current backups of all data, files, and systems prior to requesting services.
Ensure you have the legal right to grant us access to your systems, devices, networks, and data.
Provide accurate information regarding your systems and issues.
Maintain adequate security measures including antivirus software, firewalls, encryption, and access controls.
You acknowledge that failure to meet these responsibilities increases the risk of data loss, security breaches, or service interruptions.
3. Data Loss and Data Breach Disclaimer
Supportly Remote makes every effort to protect clients’ information as a standard of its business policy. However, to the maximum extent permitted by law:
Supportly Remote shall not be held legally responsible or liable for any data loss, data corruption, unauthorized access, data breach, or information leak, whether accidental or otherwise.
This includes, but is not limited to, loss of personal data, financial data, confidential information, business records, or intellectual property.
The Client is solely responsible for maintaining secure backups and complying with all applicable data protection and privacy laws.
By using our services, you expressly acknowledge and accept these risks.
4. Limitation of Liability
To the fullest extent permitted by law:
Supportly Remote’s total liability for any claim arising out of or related to our services shall not exceed the total amount paid by the Client for the specific service giving rise to the claim.
In no event shall we be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, business interruption, or reputational harm.
5. No Warranty
All services are provided on an "as-is" and "as-available" basis. We make no warranties, express or implied, including but not limited to:
Merchantability
Fitness for a particular purpose
Non-infringement
Guarantee of security or uninterrupted service
6. Third-Party Software and Services
Supportly Remote may assist with or recommend third-party software, tools, or services. We are not responsible for:
The performance, security, or reliability of third-party products
Licensing compliance for third-party software
Any damages caused by third-party providers
All third-party terms and licenses remain the responsibility of the Client.
7. Confidentiality
We take reasonable measures to maintain confidentiality; however:
We do not guarantee absolute security of information accessed during service delivery.
We are not responsible for breaches caused by factors beyond our control, including malware, compromised credentials, or insecure client systems.
8. Independent Contractors
Supportly Remote may use independent contractors to provide services. Contractors are bound by confidentiality obligations; however, Supportly Remote is not responsible for intentional or criminal acts committed outside the scope of authorized work, to the extent permitted by law.
9. Indemnification
You agree to indemnify and hold harmless Supportly Remote, its owners, employees, and contractors from any claims, damages, losses, liabilities, or expenses (including attorney fees) arising from:
Your misuse of our services
Your failure to maintain backups or security
Your violation of laws or third-party rights
10. Termination
We reserve the right to refuse or terminate service at any time, with or without notice, if:
These Terms are violated
We believe continued service poses legal, security, or ethical risk
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State in which Supportly Remote is registered, without regard to conflict of law principles.
12. Changes to Terms
Supportly Remote reserves the right to modify these Terms at any time. Continued use of services constitutes acceptance of updated Terms.

By using Supportly Remote’s services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
